About the role:

The Counsel I – Preventice Privacy Counsel and HIPAA Privacy Officer shall provide, under the supervision of the BSC Global Privacy Team, privacy advice and counsel to Preventice. In this role, the Counsel I will be part of the BSC Global Privacy Team and is expected to advise division leadership on privacy risks and recommended strategies and collaborate with all levels of the Preventice organization to ensure that Preventice operations and business initiatives comply with all applicable privacy laws and regulations.

Your responsibilities will include:
⦁    Act as HIPAA Privacy Officer for Preventice Solutions.
⦁    Oversight and drafting of Privacy policies, procedures and notices to ensure Preventice meets the requirements of applicable privacy laws and regulations.
⦁    Oversight of initial and ongoing training for Preventice workforce members on the policies and procedures related to Protected Health Information as necessary and appropriate to carry out their job-related duties.
⦁    Oversight of patient medical record request process and other related processes.
⦁    Oversight of receipt, documentation and follow up to complaints related to the Preventice Notice of Privacy Practices and related matters.
⦁    Collaborate with business stakeholders to ensure compliance of day-to-day operations and business initiatives with applicable privacy laws, regulations and contractual obligations.
⦁    Draft, review and negotiate privacy and data protection terms in master service agreements, clinical research agreements, software license agreements, SOWs and other commercial agreements. 
⦁    Negotiate Business Associate Agreements.
⦁    Investigate and appropriately respond to potential non-compliance with company privacy policies and procedures.
⦁    Liaison with Boston Scientific European Data Protection Officer on matters pertaining to the GDPR.
⦁    Collaborate with BSC Global Privacy team members regarding potential privacy incidents and appropriate follow up measures.
⦁    Remain current and update business leaders and other key stakeholders, proactively, on new privacy laws and regulations and competitive benchmarking that may impact the business.
⦁    Provide legal assistance in other areas as needed.

 Required Qualifications:
⦁    J.D. from an accredited university with admission to practice law in at least one state
⦁    5+ years of applicable legal experience
⦁    Understanding of HIPAA, GDPR and other global privacy and data protection laws and regulations required
⦁    Direct law firm or in-house experience advising on healthcare privacy

Preferred Qualifications:
⦁    Certification in one or more of the following:

       - International Association of Privacy Professionals certification: IAPP/US

       - Certified in Healthcare Privacy Compliance (CHPC) by the Health Care Compliance Association

⦁    Knowledge of industry standards affecting privacy and information security, such as NIST and ISO 27001/27002 preferred; Privacy and/or security professional certifications (e.g., CIPP) also a plus
⦁    HIPAA Covered Entity experience
⦁    Strong communication, interpersonal and project management skills
⦁    Ability to work independently and drive results
⦁    Pro-active attitude and approach towards continuous improvement
⦁    Dedicated commitment to the highest standards of quality, integrity, ethics and professionalism
